Beta Programme Terms and Conditions

1. Introduction

1.1 These Beta Programme Terms and Conditions (“Beta Terms”) govern your participation in the Fire Record beta testing programme. By accessing or using the software during the Beta Programme, you agree to be bound by these Beta Terms.

1.2 Fire Record is operated by ElevateCore (“we”, “us”, “our”).

2. Beta Programme Scope

2.1 The Beta Programme provides early access to our fire risk assessment documentation software for evaluation and testing purposes.

2.2 During the Beta Programme, the software may be provided on a free or paid basis as specified at signup or as otherwise communicated to you.

2.3 The Beta Programme will continue until we notify you by email that the Beta Programme has ended, at which point standard subscription terms will apply.

3. Eligibility

3.1 By participating in the Beta Programme, you warrant that you:

  • Are a competent person capable of carrying out fire risk assessments in accordance with BS 9792:2025 or PAS 79-1:2020 as applicable
  • Hold valid Professional Indemnity insurance with minimum cover of £1,000,000 covering fire risk assessment activities
  • Are acting in the course of a business, trade, or profession (not as a consumer)
  • Have the authority to enter into these Beta Terms

4. Nature of Beta Software

4.1 You acknowledge and accept that:

  • The software is under active development and may contain errors, bugs, or defects
  • Features may be incomplete, changed, or removed without notice
  • The software may not perform as expected in all circumstances
  • Data loss may occur; you should maintain independent backups of all assessment data
  • Service availability is not guaranteed

4.2 The software is provided “AS IS” and “AS AVAILABLE” without warranty of any kind, whether express or implied.

5. Your Responsibilities

5.1 As a beta participant, you agree to:

  • Independently verify all report outputs before issuing to clients
  • Report any bugs, errors, or unexpected behaviour to us promptly
  • Provide reasonable feedback on your experience when requested
  • Use the software only for its intended purpose of generating fire risk assessment documentation
  • Maintain appropriate professional indemnity insurance throughout your participation

5.2 You remain solely responsible for:

  • The professional content and accuracy of all fire risk assessments
  • Ensuring you are competent to conduct the assessments you undertake
  • Compliance with all applicable fire safety legislation
  • Reviewing and verifying all content generated or assisted by the software

6. What the Software Does Not Do

6.1 To avoid doubt, the software:

  • Does NOT conduct fire risk assessments
  • Does NOT provide professional fire safety advice
  • Does NOT replace professional judgement or competence
  • Does NOT verify the accuracy of information you input
  • Does NOT guarantee compliance with fire safety legislation

6.2 The software is a documentation tool that assists competent fire risk assessors in generating reports based on their own professional assessments and inputs.

7. Limitation of Liability

7.1 Our total aggregate liability to you in respect of all claims arising under or in connection with the Beta Programme shall not exceed ONE THOUSAND POUNDS (£1,000).

7.2 We shall not be liable to you for any:

  • Indirect, consequential, or special losses
  • Loss of profits, revenue, or business
  • Loss of data
  • Losses arising from your professional negligence
  • Losses arising from your failure to verify report content

7.3 Nothing in these Beta Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

8. Indemnity

8.1 You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, costs, and expenses arising from:

  • Your breach of these Beta Terms
  • Your negligence or professional misconduct
  • Claims by your clients or third parties relating to fire risk assessments you have conducted
  • Your failure to verify or review report content before issuing
  • Your failure to maintain appropriate professional indemnity insurance

9. Intellectual Property

9.1 We retain all intellectual property rights in the software, including all updates, modifications, and improvements.

9.2 You retain ownership of the content you create using the software, including your fire risk assessment reports.

9.3 You grant us a non-exclusive, royalty-free licence to use anonymised and aggregated data from your use of the software for the purpose of improving our services.

10. Confidentiality and Feedback

10.1 You agree to keep confidential any non-public information about the software, including its features, performance, and any bugs or issues you discover.

10.2 Any feedback, suggestions, or ideas you provide to us regarding the software shall become our property, and we may use such feedback without restriction or compensation.

11. Termination

11.1 Either party may terminate participation in the Beta Programme at any time by providing written notice.

11.2 We may suspend or terminate your access immediately if you breach these Beta Terms.

11.3 Upon termination, you may export your data for a period of 30 days, after which we may delete your account and associated data.

12. Transition to Paid Service

12.1 The Beta Programme will remain in effect until we notify you by email that the Beta Programme has ended. Upon such notification, continued use of the software will be subject to our standard Terms of Service and subscription fees.

12.2 We will provide you with at least 30 days’ notice by email before the Beta Programme ends.

12.3 You are under no obligation to continue using the software after the Beta Programme ends.

13. General Provisions

13.1 These Beta Terms are governed by the laws of Georgia. The courts of Georgia shall have exclusive jurisdiction.

13.2 If any provision is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13.3 These Beta Terms constitute the entire agreement between you and us regarding participation in the Beta Programme.
